action to recover



Action to recover usually describes the use of legal procedures, up to and including court hearings and any subsequent actions. It is undertaken by the creditor against a debtor.

Because it has costs associated, which can grow, creditors rarely use the courts if there is doubt about the ability to pay. Any threat of action to recover should be taken seriously, but there is a need to distinguish between proforma threats and actual notice of action.
